My purpose here is to describe a type of argument characterized by the fact that one of its premises is a directive—i.e. what is expressed by a directive sentence: a general instruction how to proceed or act. This directive premise brings an ostensive mechanism for the inclusion of visual or multimodal elements in an argument. If an argument is an invitation to inference, by using such a directive utterance the addresser is inviting the addressee to make an inference from an (...) image, not from a proposition. Hence I will call them arguments from ostension or from deixis. (shrink)

La concepción predominante de la argumentación sigue privilegiando la dimensión representacional del lenguaje y, en consecuencia, ignora o infravalora las funciones compromisorias, directivas o expresivas de la argumentación. En este artículo examino los usos de la argumentación en la esfera pública -con especial atención a la deliberación y a la negociación- para poner de manifiesto y reivindicar la importancia de las funciones no persuasivas de la argumentación, entre las que se destaca la construcción y moldeado de identidades sociales.

I offer an account of _a fortiori_ arguments in the context of a Toulmin-style theory of argumentation schemes. _A fortiori_ arguments contain a comparison of the strength of two or more arguments involving scalar inferences. We can distinguish two kinds of _a fortiori_ arguments depending on whether those scalar inferences connect the premises and the conclusion or the backing and the warrant of the arguments. The first pattern has been studied by rhetoricians and the second pattern by legal argumentation theorists.

La tesis central de este artículo es que la argumentación por analogía consiste en la transferencia de un argumento de un dominio a otro con la pretensión de que el argumento término será bueno si lo es el argumento fuente. El examen de algunos argumentos filosóficos tradicionalmente considerados analógicos lleva a distinguir dos tipos de transferencia analógica. Cuando la transferencia se justifica con un principio abductivo como a casos similares, explicaciones similares, el argumento término es más débil que el argumento (...) fuente, pero cuando se aduce que en los dos dominios valen las mismas razones, la fuerza de los dos argu-mentos es proporcional.I contend that analogical argumentations transfer an argument from one domain to another, intending that the target argument will be good if the source argument is good. After analysis of some philosophical arguments traditionally taken to be analogical, I conclude that there are two kinds of analogical transfer. When some abductive principle like similar cases should have similar explanations is used, the target argument is weaker than the source argument; when it is claimed that the same reasons hold in both domains the strength of both arguments is proportional. The debate on the a fortiori and the universal that took place between April 1914 and April 1919 in the journal Mind has a double interest for argumentation theorists. First, the discussion is an example of a philosophical polylogue that exhibits the characteristics of a quasi-engaged dialogue (Blair Blair, J. A. (2012 [1998]). “The Limits of the Dialogue Model of Argument”. Argumentation 12, pp. 325–339. Reprinted in J.A. Blair, Groundwork in the Theory of Argumentation, pp. 231–244. Dordrecht: Springer, 2012.), confirming (...) Blair’s hypothesis that journal papers and scholarly monographs can be analyzed as turns in non-engaged or quasi-engaged dialogues. It could be said that philosophical argumentation is dialectical but not dialogical. Second, the debate is a discussion in argumentation theory. Generalism in the theory of argument claims that the very possibility of arguing depends on a suitable supply of general rules that specify what kinds of conclusions can be drawn from what kinds of data, while particularism denies this. Although the terminology may be alien, I will also show that the debate on the a fortiori and the universal was a debate on generalism and particularism. (shrink)

Anyone interested in philosophical argumentation should be prepared to study philosophical debates and controversies because it is an intensely dialogical, and even contentious, genre of argumentation. There is hardly any other way to do them justice. This is the reason why the present special issue addresses philosophical argumentation within philosophical debates. Of the six articles in this special issue, one deals with a technical aspect, the diagramming of arguments, another contrasts two moments in philosophical argumentation, Antiquity and the twentieth century, (...) focusing on the use of refutation, and the remaining four analyze particular philosophical controversies. The controversies analyzed differ significantly in their characteristics (time, extension, media, audience,…). Hopefully, this varied sample will illuminate some salient aspects of philosophical argumentation, its representation and variations throughout history. We are fully aware that, given the scarcity of previous studies of philosophical debates from the perspective of argumentation theory, the following specimens of analysis must have several shortcomings. But it is a well-known adage that the hardest part is the beginning. That is what we tried to achieve here, no more, but no less either. (shrink)

Estas prácticas, que son públicas –las realizamos ante otros– y normativas –esos otros pueden criticarnos y pedirnos justificaciones–, son el objeto de estudio de En buena lógica. Una introducción a la teoría (...) de la argumentación. En los ocho capítulos que componen el libro el autor, Hubert Marraud, presenta una serie de conceptos y herramientas teóricas que permiten entender mejor las complejidades de un fenómeno que por sernos familiar a veces resulta difícil de aprehender. The paper presents a dialogical approach applied to the analysis of argumentative strategies in philosophy and examines the case of the critical comments to the Tanner Lectures given by the Dutch biologist and primatologist, Frans de Waal, at Princeton University in November 2003. The paper is divided into five parts: the first advances the hypothesis that what seem puzzling aspects of philosophical argumentation to scholars in other academic fields are explained by the global role played by a series of arguments (...) within a broader argumentative strategy, e.g. arguing that a question that seems important is not really worthwhile; the second presents five groups of dialectical operations, making use of concepts and tools from the dialectical dialogical approach (WaltonWalton and Krabbe, Commitment in Dialogue: Basic Concepts of Interpersonal Reasoning, SUNY Press, Albany, 1995), Hubert Marraud's Argument dialectic (Marraud, En buena lógica. Una introducción a la teoría de la argumentación, Editorial Universidad de Guadalajara, Guadalajara, 2020) and from the vast tradition of formal dialectics and dialogical logic. This article reviews Fernando Leal and Hubert Marraud’s How Philosopher’s Argue: An Adversarial Collaboration on the Russell-Copleston Debate (Springer 2022).

This article examines gender imbalance in philosophy using statistical analysis of philosophy professionals and students in Spain. It is the only study on an international scope that provides complete, real data of an entire national system. This analysis shows that among teaching and research personnel, women make up 25% of the total, among full professors they represent 12%, and the glass-ceiling index in the field is the same as that in engineering. For the study, I resorted to a normalization of (...) indicators to allow for international comparisons, which I have done using the reports and analyses available in other countries. In the second part of the article, I use the Spanish data to test some recent hypotheses on gender imbalance in philosophy. The data does not confirm the theory of Neven Sesardic and Rafael de Clercq, which attributes the imbalance to differences in cognitive abilities. However, the data does partially confirm the study by Molly Paxton, Carrie Figdor, and Valerie Tiberius regarding the dissuasive effect of introductory courses in philosophy, as well as that by Sarah Leslie and her colleagues on the field-specific abilities belief hypothesis. A feature of suppositional arguments is that a conclusion is drawn on the basis not just of assertives or statements, but of an argument. To cover suppositional arguments, many authors have proposed to expand the concept of a premise so that it includes not only assertives or statements but also arguments. In this paper, some of the consequences of this approach for the theory of arguments are explored.

This paper examines the legitimacy conditions of constitutionalism by examining one particular type of constitutional provision: provisions aimed at advancing future generations’ interests. After covering the main forms that such provisions can adopt; it first considers three legitimacy gains of constitutionalising them. It then explores two legitimacy concerns that so doing raises. Given that constitutions are difficult to amend; constitutionalisation may threaten future generations’ sovereignty. And it may also make the constitution’s content impossible to adapt to changing circumstances and interests. (...) Finally; the paper examines the ways in which such concerns may be addressed at the adoption; formulation; and amendment stages. This dissertation is a study of the relationship between dunamis and energeia in Aristotle’s ontology. Throughout his writings, Aristotle employs these terms to uncover what I call a proto-phenomenological description of the different ways of being. While contemporary scholarship has suggested the significance of dunamis and energeia for Aristotle’s understanding of being, the relationship between these terms has often been interpreted as mutually exclusive. Accordingly, dunamis would be understood as subordinate to energeia, which would function as the sole primary term (...) of Aristotle’s ontology. I argue that it is a mistake to consider dunamis and energeia as non-reciprocal and subordinate terms. Furthermore, I suggest that this mistake often leads to an underestimation of the dynamic character of Aristotle’s proto-phenomenological account of being. To recover this dimension of Aristotle’s thinking, I claim that dunamis and energeia ought to be understood as reciprocal and co-constitutive terms characterized by a constant and dynamic interrelation. To defend this interpretation, I turn to Aristotle’s conceptions of nature, movement, and soul as discussed in the Metaphysics, Physics, and De Anima. I argue that each of these key terms provide a concrete illustration of how dunamis and energeia function as co-constitutive principles for the manifestation of the being of natural beings. I propose that this proto-phenomenological approach to being remains Aristotle’s most significant and enduring contribution to Western ontology. (shrink)

The republican case for workplace democracy is presented and defended from two alternative means of ensuring freedom from arbitrary interference in the firm—namely, the right to freely exit the firm and workplace regulation. This paper shows, respectively, that costless exit is neither possible nor desirable in either perfect or imperfect labor markets, and that managerial discretion is both desirable and inevitable due to the incompleteness of employment contracts and labor legislation. The paper then shows that WD is necessary, from a (...) republican standpoint, if workers’ interests are to be adequately tracked in the exercise of managerial authority. Three important objections are finally addressed— that WD is redundant, that it is unnecessary provided that litigation and unionism can produce similar outcomes, and that it falls short of ensuring republican freedom compared to self-employment. This paper outlines a procedure for assessing the quality of failure explanations in engineering failure analysis. The procedure structures the information contained in explanations such that it enables to find weak points, to compare competing explanations, and to provide redesign recommendations. These features make the procedure a good asset for critical reflection on some areas of the engineering practice of failure analysis and redesign. The procedure structures relevant information contained in an explanation by means of structural equations so as to (...) make the relations between key elements more salient. Once structured, the information is examined on its potential to track counterfactual dependencies by offering answers to relevant what-if-things-had-been-different questions. This criterion for explanatory goodness derives from the philosophy of science literature on scientific explanation. The procedure is illustrated by applying it to two case studies, one on Failure Analysis in Mechanical Engineering (a broken vehicle shaft) and one on Failure Analysis in Civil Engineering (a collapse in a convention center). The procedure offers failure analysts a practical tool for critical reflection on some areas of their practice while offering a deeper understanding of the workings of failure analysis (framing it as an explanatory practice). It, therefore, allows to improve certain aspects of the explanatory practices of failure analysis and redesign, but it also offers a theoretical perspective that can clarify important features of these practices. Given the programmatic nature of the procedure and its object (assessing and refining explanations), it extends work on the domain of computational argumentation. (shrink)

Against Davidsonian (or deflationary) realism, it is argued that it is coherent to believe that science can in principle give us access to the functional components of the universe as they are in themselves in distinction from how they appear to us on the basis of our quotidian concerns or sensory capacities. The first section presents the deflationary realist's argument against independence. The second section then shows that, although Heidegger pioneered the deflationary realist account of the everyday, he sought to (...) establish a robust realist account of science. Next, the third section develops two different sides of Heidegger's thinking. Resources developed by Thomas Kuhn are drawn on to work out Heidegger's account of plural worlds. This argument shows that it makes sense to talk about things-in-themselves independent of our practices, but falls short of the robust realist claim that we can have access to things as they are in themselves independent of our practices. So, secondly, Saul Kripke's account of rigid designation is drawn on to work out Heidegger's account of formal designation. On the basis of a Heideggerian elaboration of rigid designation, it is argued that we do indeed have practices for achieving access to things independent of all our practices. But this second argument leaves us unable to reject metaphysical nominalism. So, thirdly, it is proposed that the currently most persuasive philosophical argument for nominalism depends on a logico-mathematical space of possibilities. But the proto-theoretical space opened by the pre-scientific access practices has features that provide reasons for believing that the independent stuff to which we have access has a determinate structure and specific causal powers. This volume, the third in this Springer series, contains selected papers from the four workshops organized by the ESF Research Networking Programme "The Philosophy of Science in a European Perspective" in 2010: Pluralism in the Foundations of Statistics Points of Contact between the Philosophy of Physics and the Philosophy of Biology The Debate on Mathematical Modeling in the Social Sciences Historical Debates about Logic, Probability and Statistics The volume is accordingly divided in four sections, each of them containing papers coming (...) from the workshop focussing on one of these themes. While the programme's core topic for the year 2010 was probability and statistics, the organizers of the workshops embraced the opportunity of building bridges to more or less closely connected issues in general philosophy of science, philosophy of physics and philosophy of the special sciences. However, papers that analyze the concept of probability for various philosophical purposes are clearly a major theme in this volume, as it was in the previous volumes of the same series. This reflects the impressive productivity of probabilistic approaches in the philosophy of science, which form an important part of what has become known as formal epistemology - although, of course, there are non-probabilistic approaches in formal epistemology as well. It is probably fair to say that Europe has been particularly strong in this area of philosophy in recent years.​. (shrink)

Black mothers often are responsible for teaching their children how to respond to police violence. Through 30 in-depth interviews with black mothers from diverse social class backgrounds, I investigate how they address the gendered racial vulnerability of their children in the “police talk,” a socialization practice designed to prepare children for police encounters. I identify mothers’ primary discourse as “the making it home” framework, which encapsulates in parent–child socialization their use of double consciousness around the police. This framework marginalizes girls’ (...) experiences in three ways: it conceptualizes boys as the primary targets of police, while constructing girls as collateral targets of police violence; it emphasizes masculine forms of violence; and it is directed almost exclusively at boys. An intersectional analysis is applied to redress the limitations of the police talk and to highlight the need for structural reforms to recognize and combat police violence against black women and girls. In this paper, we evaluate Button’s claim that knot is a nasty connective. Knot’s nastiness is due to the fact that, when one extends the set \ with knot, the connective provides counterexamples to a number of classically valid operational rules in a sequent calculus proof system. We show that just as going non-transitive diminishes tonk’s nastiness, knot’s nastiness can also be reduced by dropping Reflexivity, a different structural rule. Since doing so restores all other rules in the system as (...) validity-preserving, we are inclined to conclude that there, knot is not that nasty. However, since motivating non-reflexivity is harder than motivating non-transitivity, we also acknowledge that disagreement with our conclusion is possible. (shrink)

A filosofia alemã do século XIX posterior a Hegel está bastante estudada em três direções. A primeira, que surge da luta entre hegelianos de esquerda e direita, acaba por conduzir ao materialismo e ao marxismo; a segunda, que se expressa na vertente irracionalista e anti-sistemática, passa por Schopenhauer, Kierkegaard e Nietzsche; a terceira é constituída pelo neo-kantismo e suas derivações, cuja versão oficial teria suas raízes fincadas pelo famoso discurso inaugural de Zeller e pelo livro de Otto Liebmann, que deram (...) o impulso ao movimento “Zurück zu Kant”. Em tal visão de conjunto, o grande ausente é um movimento contínuo, ainda quando irregular e multifacetado, que terminará conduzindo à filosofia contemporânea. Este movimento tem em Trendelenburg uma figura chave. É com suas “Investigações Lógicas” que se inicia a reformulação das relações entre filosofia e ciência e, neste sentido, o verdadeiro retorno a Kant. O fato de sua obra principal ter exatamente o mesmo nome que a coleção de ensaios temáticos de Frege, a obra de ruptura de Husserl e as dissertações de doutorado de Cohen, Dilthey e Brentano significa algo mais que curiosas coincidências. “Zurück zu Kant” (Adolf Trendelenburg the overcoming of idealism and the roots of contemporary philosophy) Abstract Considering history of philosophy as a whole, the two main traditions of thought from the 20th century (analytic and phenomenological-hermeneutic) can be regarded as being variants of one same fundamental turn. This systematic relation is connected to a common historical root. To highlight it implies to review the ideas that are deeply in the basis of the historiography of the German thought in the 19th century. Beyond names, problems and theses that may appear to have at first sight no relationship whatsoever, we can notice a continuous unitary development that has not yet received all the attention it deserves. In this movement, Adolf Trendelenburg stands out, once the beginners of both the abovementioned traditions and of neokantianism (Frege, Brentano, Dilthey and Cohen) received a decisive impulse from his reflections. Background Abortion is one of the most common gynaecological procedures. It is related to personal, social, and economic reasons under a legal term that is recognised as a common sexual and reproductive right in most of countries. However, making the decision to abort is complex, because it is politicised and is often framed in public discourse related to moral or ethical issues beyond women’s experiences. Therefore, it is subject to medical criteria, religious evaluations, and sociological analysis. Purpouse The aim of (...) this synthesis of qualitative studies was to synthesise the decision-making experiences of women who legally aborted. Research design and method The Noblit and Hare’s interpretive meta‐ethnography was conducted, and it was written in accordance with the eMERGe meta‐ethnography reporting guidance. Ten studies met the research objective and inclusion criteria, after a comprehensive systematic search strategy in five databases. Findings The metaphor “The wrestling between why and what will happen next” and three themes emerged from the data analysis: (1) Forces that incite the arm wrestling; (2) Facing social stigma; and (3) Defeated by a greater rival. The metaphor provided interpretive experiences of the moral conflict experienced by women who decided to have an abortion and emerged from the confrontation of the reasons why they decided to abort and the social repercussions that making the decision entails. The result of the struggle was loneliness and vulnerability. Conclusion The lines of action impact policy makers, the media, and health professionals. Actions should focus on the de-stigmatisation and normalisation of abortion, the use of appropriate language, and the training and sensitisation of health professionals. (shrink)

The current quality assurance culture demands the explicit articulation, by means of publication, of what have been hitherto tacit norms and conventions underlying disciplinary genres. The justification is that publication aids student performance and guarantees transparency and accountability. This requirement makes a number of questionable assumptions predicated upon what we will argue is an erroneous epistemology. It is not always possible to articulate in a publishable form a detailed description of disciplinary practices such as assessment. As a result publication cannot (...) achieve its stated goals. There are always elements of our knowledge that cannot be linguistically articulated. (shrink)
